Terms of Service

1. Acceptance of Terms

By using the DreamFX service ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

2. Description of Service

DreamFX converts photographs into short videos using AI models from third-party providers (Runway, Luma, Kling AI). You upload an image, pick an effect, and we return an AI-generated video.

3. Eligibility

You must be at least 18 years of age to use the Service and have an active Direct Carrier Billing (DCB) subscription with a supported carrier (Etisalat, du).

4. Subscription and Billing

• The Service is billed through your monthly carrier bill or prepaid balance.
• Pricing and daily video quotas are defined by the carrier in our agreement with them.
• Billing starts immediately upon activation and renews automatically until cancelled.
• You can cancel at any time via your carrier's channel (SMS, USSD, or customer portal).

5. Acceptable Use

You must not use the Service for any of the following:

• Illegal content or content that violates UAE laws and Islamic values.
• Sexual, pornographic, or sexually suggestive content.
• Violent, graphic, or content that incites hatred or violence.
• Images of minors (under 18) in any sexual or inappropriate context.
• Creating deepfakes of real people without their explicit consent.
• Impersonating celebrities, politicians, or religious figures.
• Infringing intellectual property rights (images, logos, protected characters).
• Fraud, phishing, or spreading misinformation.

We reserve the right to refuse or remove any content and to terminate your account without prior notice in case of violation.

6. Content Ownership and License

• You retain ownership of the images you upload.
• By uploading, you grant us a limited, non-exclusive license to process the image and send it to our AI providers to generate the video.
• You retain ownership of the generated videos and may use them for personal or commercial purposes, subject to the AI providers' terms.
• We may retain anonymized, non-identifying data (with no facial images) for Service-improvement purposes.

7. Disclaimers

The Service is provided "as is" and "as available". We use third-party AI models that may produce unexpected, inaccurate, or undesirable results. We do not guarantee:

• A specific level of quality or accuracy in the generated videos.
• Uninterrupted availability of the Service.
• That every generation request will complete successfully.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability in all cases is capped at the amount you paid to us in the three months preceding the event.

9. Termination

We may suspend or terminate your account immediately and without notice if:

• You violate the Acceptable Use policy.
• Your DCB subscription is cancelled or expires.
• We receive a legitimate request from competent authorities.

10. Cancelling Your Subscription

To cancel your subscription, use your carrier's official channel (cancellation SMS, USSD, or customer portal). Once cancelled, new billing stops, but access to the Service may remain until the end of the current billing cycle.

11. Changes to These Terms

We may modify these Terms from time to time. The updated version will be posted with a new date. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates, in particular the laws of the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction over any dispute arising out of these Terms.
